The Florida Legislature Opens The Door to Time-Barred Abuse Cases

This past Monday the Florida Legislature partially abolished the statute of limitations applicable to sexual batteries committed on victims under age 16. It applies not only to civil actions against perpetrators but also to third parties that could have prevented the battery. The bill unanimously passed both chambers and Governor Crist is expected to sign it.

As worded, the bill "looks back" four years from its effective date, July 1, 2010, so cases arising on or after July 1, 2006 can never be barred by the statute of limitations. Here is a copy of the bill ...
